Navigating the Employment Rights Act 2025 - A planning and readiness guide for employers Extension of employment tribunal time limits • On 1 October 2026, the time limit for submitting most types of claim to an Employment Tribunal will extend to six months. • This change and the delays in the Tribunal system mean you may not become aware of a claim for many months after an employee has left the business. • Find out more about the reform Document retention policies may need to be reviewed to ensure they take into account the extended time limit for bringing claims. As part of the above, make the appropriate line managers aware of this change so that they are aware of the importance of retaining documents and other potential evidence e.g. CCTV recordings. Where you think an employee may bring a claim, you may also want to take preliminary statements from witnesses whilst events are fresh in their minds and in case key witnesses leave your business before any final hearing.
