Case studies Ministry of Defence Advising on the full suite of contracting arrangements in relation to the procurement of Dreadnought and Astute class submarines, from the alliancing and collaboration arrangements to the bi-lateral contracts for both programmes. Also supporting on negotiating, drafting and procurement of contracts with strategic suppliers to the naval nuclear propulsion programme. Ministry of Defence Advised on the Skynet satellite programme since the late 1990s including on the first outsourcing through the Skynet 5 PFI project, which involving the manufacture and launch of two satellites. Currently advising on the Skynet 6 programme to appoint a replacement service provider following expiry of the PFI for the supply and integration of the Skynet 6A satellite and subsequent procurement of satellites under the Enduring Capability Programme. Isle of Wight Council Advising on the £1bn Highways Maintenance PFI project, including drafting the Project Agreement and managing stakeholder issues, including HM Treasury and IPA (predecessor) comments and subsequent advice on variations and a contractual dispute. Case studies Civil Aviation Authority Acting for the regulator, on a large number of matters involving reporting on proposed changes to the debt and equity structures of ATOL licence holders and ensuring that the CAA’s objectives, including the protection of customers, are appropriately addressed. This includes recommending, negotiating and implementing: new security, guarantees, subordination or other contractual protections in favour of the CAA. Acting for the joint administrators from FRP on the negotiation and agreement of the sale of the Coventry Arena (including the associated businesses) to Frasers Group. The transaction was completed on a very accelerated timetable and was carried out alongside a parallel urgent application to court which was necessary in order to obtain an order appointing the joint administrators and consenting to the sale of the Coventry Arena free from fixed charge security. Advising one of the largest unsecured creditors of a distressed further education body including liaising with insolvency practitioners engaged by the Department for Education in relation to an accelerated M&A process, liaising with the FE body and the Charity Commission in relation to emergency funding from ESFA and advising on possible outcomes in an Education Administration. Case studies Higher Education Advising Babcock Training Limited on the contractual arrangements necessary to enter into a partnership with the Metropolitan Police as lead provider of the delivery of new recruit training and assessment through two new Level 6 qualifications. This eightyear contract was awarded to Babcock following a regulated procurement process. Babcock worked with a consortium of London based universities as part of its bid, Anglia Ruskin University, Brunel University, University of East London and University of West London. The qualifications will be collaboratively delivered by Babcock and the HEIs. Schools Significant experience advising on the restructuring and delivery of education support services to schools.
