BURGES SALMON LLP Public Inquiries and Inquests How we can help you Our public inquiries and inquests lawyers work closely with clients to understand their business objectives and the unique challenges that arise from each individual project. We represent clients at inquests (including ‘super’ inquests with multiple Interested Persons) and inquiries, often in high profile cases requiring a sensitive approach. We feel passionately that inquiries and inquests, when conducted effectively, are a force for establishing facts and driving positive change. That belief motivates our approach and our results for, and alongside, our clients. We have worked with many of the specialist counsel in the inquiry and inquests specialism. Also our team includes advocates with Higher Court Rights of Audience who are members of the Solicitors’ Association of Higher Court Advocates. To deliver this key specialism, Burges Salmon has a collaborative arrangement with Fieldfisher LLP to work as a combined team for the new Lot 1 panel, providing strength and depth of experience. Fieldfisher’s Inquests and Inquiries team is led by partners Martin Smith, Tim Suter and Oliver Carlyon, who draw on a wider team of 25 individuals with security clearance working full time on high profile inquest and public inquiry matters. Our combined expertise includes: • Carrying out the role of a solicitor under the Inquiries Act 2005 and Inquiry Rules 2006 including in relation to the assessment of awards of legal costs to Core Participants • Providing legal advice and support to Inquiry Chairs on all legal aspects relating to the inquiry • Instructing and working with Inquiry Counsel and monitoring the inquiry’s own legal spend • Management and collation of documentation including the maintenance of the inquiry record, the provision and management of virtual data rooms and/or e- disclosure, and facilitating the transfer of the inquiry record to the appropriate public record office • Devising and implementing fair and robust procedures and protocols for the conduct of the inquiry • Conducting the response to any judicial review brought against the Inquiry Chair • Providing legal support to serving and former ministers and civil servants responding to inquiries and inquests • Taking witness statements, providing legal advice and support • Instructing counsel to represent the interests of individual witnesses where required. Case studies Solicitor to the Inquest and Solicitor to the Inquiry services Acting in relation to the 7/7 London Bombing Inquests, The Hillsborough Inquests, The Inquests into the Birmingham Pub Bombings, The Litvinenko Inquiry, The Independent Inquiry into Child Sexual Abuse, The Manchester Arena Inquiry and the Jermaine Baker Inquiry. Home Office and MHCLG Acting for two government department Core Participants to the Grenfell Tower Inquiry (Home Office and MHCLG) in relation to the collation, review, and analysis of evidence for submission to the inquiry. We mobilised a team of 60 reviewers swiftly to deliver a high quality output to the inquiry on behalf of our clients involving several hundred thousand documents extending back over several decades. Non-departmental government body Advising in relation to the Redfern Inquiry to investigate and report on the use of human tissue by the UK nuclear industry. We provided detailed written submissions as well as acting as the advocate for our client at the inquiry hearings. Core Participants (combined experience of Burges Salmon and Fieldfisher) We have acted for one or more Core Participants in every UK major Rail Collision accident since privatisation in 1995 including all public inquiries held and a large number of Article 2 inquests), including Southall, Ladbroke Grove, Hatfield, Great Heck (Selby) Potters Bar, Ufton Nervet, Grayrigg, Sandilands, and Carmont/Stonehaven. This includes, for example, acting for a tram operating company in relation to the 2016 multi-fatality incident at Sandilands, Croydon. Burges Salmon acted throughout on the incident response, regulatory investigations, data collection, engagement with stakeholders and participation in the highly detailed 10 week inquests in 2021. We have also acted for a variety of other Core Participants, including The London Fire & Emergency Planning Authority in relation to The Grenfell Tower Inquiry. Back to contents Back to contents 44

BURGES SALMON LLP Public International Law How we can help you Our public international team has expertise in assisting clients with cross-border regulatory issues, trade-regulated litigation, labelling and country of origin advice, business immigration, inward investment, cross-border M&A and international taxation. Our nuclear team is also recognised for advising on the requirements of international nuclear law around the world. We act for governments, state owned nuclear developers, regulators and large international collaborations. Case studies Eurostar Advising directly and on the engagement with former UK government shareholder LCR, on the application of the Treaty of Canterbury between UK and France relating to management of the Channel Tunnel Fixed Link. Our advice covered issues such as oversight of safety compliance and responsibility and making submissions to the Inter-Government Commission set up to monitor the fixed link, charging and rights of access (including their overlap with later EU, UK and French law). Department for International Trade clients Advising DIT clients such as GCB Cocoa Singapore Ltd (the world’s fourth largest cocoa processing company) on their UK market entry and foreign direct investment projects. Nuclear regulator Acting for a nuclear regulator in the Middle East (Confidential) advising on the requirements of International Nuclear Law and best practice, training staff, reviewing and reporting on the state’s implementation of the requirements of the Convention on the Physical Protection of Nuclear Materials and reviewing and amending the state’s framework nuclear laws, regulations and regulatory guidance. Nuclear developer Advising a state owned nuclear developer in Asia (Confidential) in relation to the international nuclear law and best practice relevant to the funded decommissioning of nuclear facilities and drafting of domestic regulations. Advising NI Translink and (separately) Eurostar on continued operation and access to EU markets after Brexit leading to continuity agreements for both.
